Over the course of my fourteen-plus
year civil litigation career, I have handled hundreds [and perhaps thousands] of cases of various types,
ranging from simple breach of contract actions in Magistrate [Small Claims] Court, to complex Federal Class Actions - and
virtually every other type of civil dispute along the spectrum. While I still handle a wide range of cases and The Law Office of Auden L. Grumet, LLC remains a general civil/business
litigation law firm, since its formation almost a decade ago, the focus of my practice has shifted primarily
to Consumer Protection and Real Estate/Construction law and litigation. Generally speaking, the first category encompasses Consumer Credit, Debt, Banking and Financing
law. More specifically, the statutes and laws include Fair Debt Collection Practices Act (FDCPA), Fair Credit Billing Act (FCBA), Truth-in-Lending Act (TILA),
Dodd–Frank Wall Street Reform and Consumer Protection Act, Fair Credit Reporting Act
(FCRA), Fair and Accurate Credit Transactions Act (FACTA), Real Estate Settlement Procedures Act (RESPA), Mortgages, Home
Loan Modifications [e.g. HAMP, Loan Servicing and Escrow disputes], Truth in Leasing Act (Regulation M), Telephone Consumer
Protection Act (TCPA), Junk Fax Protection Act of 2005 (JFPA), Cybersquatting and CAN-SPAM Act, GA Motor Vehicle Warranty
Rights Act, GA Lemon Law and UCC Sales/Warranties (Magnuson Moss Warranty Act)[Extended Warranties, Service Contracts,
Auto/Vehicle Dealer Sales and Fraud, etc.]. The second category includes Materialman's/Mechanic's Liens, Landlord-Tenant disputes, Leasing, Riparian Rights,
Property Line/Boundary disputes, Trespass and related matters, some of which overlap with the first category listed above
[e.g. mortgage modifications, servicing, RESPA, Qualified Written Requests, etc.]. In addition, the firm also handles a wide range of other types of cases involving virtually
any kind of tort ("wrong") or dispute.
These include the following: Breach of Contract, Insurance/Coverage and Subrogation, ERISA, Medical Malpractice, Copyrights,
Trademarks, Interstate Transportation (Carmack Amendment), False Imprisonment/Arrest, Malicious Prosecution, Libel/Slander/Defamation,
Products and Premises Liability, Wrongful Death and even minor Traffic Defense (i.e. speeding tickets) cases, among others. Building on my extensive insurance defense practice experience and my passion for and involvement in bicycling over
the last six years, I also handle bicycling/cycling personal injury claims.
Professional Biography & Experience Prior to forming my own law firm, I was a Litigation Associate at one of the nation's largest
firms, Epstein, Becker & Green ("EBG"), where I represented both Plaintiffs and Defendants in complex business
matters. Prior to that, I began my legal career at one of Atlanta's oldest law firms, Greer, Klosik & Daugherty ("GKD"),
where I practiced almost exclusively Insurance Defense law. It was at GKD that I developed the core foundation of my civil litigation experience, by
virtue of having responsibility for handling hundreds of cases from start to finish. This included, for example, conducting
scores of depositions, attending dozens of hearings, drafting hundreds of motions and countless discovery pleadings and acting
as lead or co-counsel in at least 20 jury trials, all during the first few years of my law practice.
PLEASE NOTE: If you have a question about a dispute, claim, case,
issue or other matter, please CAREFULLY review the information and resources at the links below BEFORE contacting
me. Also, please keep in mind that I much prefer to receive, and am much more likely to respond to, inquiries and communications
sent via email, as opposed to the telephone [primarily because I have more time to devote to such matters at night, on the
weekend and otherwise after business hours]. Unfortunately, due to the volume
of telephone calls I receive, I am unable to answer general legal questions from referrals and other potential clients about
disputes or concerns for which you do not genuinely intend to retain my and my law firm's professional services.
And while I am certainly willing to briefly discuss your case or concern with you over the phone, without charge,
in order to determine if it is a matter for which you may want to formally hire me, the majority of my limited time is devoted
to helping existing clients with existing cases. In addition, due to certain professional rules of ethics, I am unable to give legal advice or answer
questions over the phone about specific disputes, issues or laws. For example, it would be imprudent and impossible to provide
competent legal advice about a dispute that involves the review of or knowledge about a contract, agreement, correspondence
or other written document [e.g. car purchase, apartment lease, garnishment, etc.]. However, I am in the process of developing some standard flat-fee arrangements whereby, for instance, I may
agree to conduct an initial contract review or draft a demand letter (and meet with you briefly), although I have not yet
decided what the specific charges or fees might be for such tasks. Please feel free to contact me for specific information
if this kind of arrangement is of interest to you.
